Donor Terms

These Donor Terms apply to you when you make a contribution through KidStarter and form part of the Agreement (see Terms of Service).
1. Nature of Donations
1.1. Donations are voluntary contributions intended to support a Campaign's stated educational goal. Donations are not purchases of goods or services, and do not entitle you to any product, service, or guaranteed outcome.
1.2. KidStarter does not guarantee that any Campaign will reach its funding goal, that any items or services will be purchased or delivered, or that any specific educational outcome will result from your donation.
1.3. By donating, you acknowledge that you have read and understood the Campaign description, and that you are making a voluntary contribution based on that information.
2. School/Vendor Disbursement Model
2.1. KidStarter's operating model directs funds exclusively to verified schools or approved vendors — never directly to students, parents, guardians, or individual persons.
2.2. Disbursements are subject to verification, documentation requirements, compliance screening, and the Disbursement Policy.
2.3. If a Campaign cannot be fulfilled as described (e.g., vendor unavailable, school declines), KidStarter will follow the reallocation and refund procedures in the Disbursement Policy and Refunds Policy.
3. Payment Processing
3.1. Payments are processed by PCI DSS-compliant third-party payment processors (e.g., Stripe). KidStarter does not store, process, or have access to your full payment card number.
3.2. You are responsible for ensuring that the payment method you use is valid and that you are authorized to use it.
3.3. Transactions are processed in the currency displayed at checkout. If your payment method is denominated in a different currency, your bank or card issuer may apply a foreign exchange conversion rate and/or additional fees. KidStarter is not responsible for exchange rates, conversion fees, or bank charges.
4. Platform Fees
4.1. KidStarter may charge a platform fee (a percentage of the donation amount) and/or an administrative fee to cover the costs of operating the Service. These fees will be clearly disclosed at checkout before you complete your donation.
4.2. Third-party payment processing fees may also apply and will be disclosed at checkout.
4.3. The net amount after fees is the amount available for disbursement to the school or vendor.
5. Recurring Donations
5.1. If you set up a recurring donation, you authorize KidStarter and its payment processor to charge your selected payment method at the frequency and amount you specify (e.g., monthly).
5.2. You may cancel a recurring donation at any time through your account settings or by contacting [SUPPORT EMAIL]. Cancellation will take effect before the next scheduled charge.
5.3. KidStarter is not responsible for charges that have already been processed before your cancellation request is received.
6. Receipts
6.1. You will receive a confirmation receipt for each donation via email for your records.
6.2. Receipts are provided for record-keeping purposes only. They do not constitute tax advice and do not imply or guarantee that your donation is tax-deductible. See Section 7 below.
7. No Tax Advice
7.1. KidStarter does not provide tax, legal, or financial advice.
7.2. Whether a donation is tax-deductible depends on your jurisdiction, the legal status of the recipient entity, the structure of the transaction, and your personal tax circumstances. Consult a qualified tax professional.
7.3. Where we provide informational links or general guidance (e.g., on the Tax Center), these are for convenience only and should not be relied upon as professional advice.
8. Refunds and Chargebacks
8.1. Donations are generally final. Refunds may be provided in the limited circumstances described in the Refunds, Chargebacks & Disputes Policy.
8.2. Chargebacks initiated through your payment provider may result in investigation, holds on related Campaign funds, and potential restrictions on your account.
8.3. Fraudulent chargebacks or abuse of the refund process may result in account suspension and reporting to payment processors.
9. EU/EEA Consumer Rights
9.1. Under the EU Consumer Rights Directive (2011/83/EU), consumers have a right of withdrawal (cooling-off period) for certain distance contracts. However, because donations are voluntary contributions and not purchases of goods or services, the statutory 14-day withdrawal right may not apply.
9.2. Notwithstanding the above, if you believe a refund is warranted, you may contact [SUPPORT EMAIL] and we will review your request in accordance with our Refunds Policy and applicable consumer protection law.
9.3. Nothing in these Donor Terms affects your statutory rights under applicable EU consumer protection law.
10. UK Consumer Rights
10.1. Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, consumers may have a 14-day cancellation right for distance contracts. As donations are voluntary contributions, this right may not apply in full.
10.2. If you are a UK consumer and wish to request a refund, contact [SUPPORT EMAIL]. We will consider your request in accordance with our Refunds Policy and applicable UK law, including the Consumer Rights Act 2015.
11. Canada Consumer Rights
11.1. Canadian consumer protection legislation may provide additional rights depending on your province. We comply with applicable provincial consumer protection laws.
11.2. Refund requests from Canadian donors will be handled in accordance with our Refunds Policy and applicable law.
12. Prohibited Transactions
You may not use the Service to:
- Violate any applicable sanctions law (including those of the US, EU, UK, and Canada);
- Launder money or facilitate terrorist financing;
- Conduct fraud or use stolen payment instruments;
- Circumvent any fee, limit, or restriction;
- Make donations that are subject to conditions or strings not disclosed to KidStarter.
We may block, reverse, freeze, or report suspicious transactions to payment processors, financial regulators, or law enforcement.
13. Donor Privacy
Your data is processed in accordance with our Privacy Notice. We share donation data with payment processors, Campaign Creators (name or alias as chosen), and schools/organizations only as necessary to process and acknowledge your donation. We do not sell your data or share it for third-party marketing.
