Creator Terms

These Creator Terms apply to teachers, legal guardians, and other verified adults who create or manage Campaigns on KidStarter. These terms form part of the Agreement (see Terms of Service).
1. Authority and Consent
You represent and warrant that you:
1.1. Have legal authority to create and manage a Campaign on behalf of the Student, including:
- teachers: authorization from the school/educational institution to create the Campaign;
- guardians: legal guardianship or parental authority over the Student;
- authorized representatives: written authorization from the guardian and/or school.
1.2. Have obtained all legally required consents and permissions, including:
- verifiable guardian consent for minors where required by applicable law (COPPA, GDPR, UK GDPR, PIPEDA);
- school authorization for Campaigns involving school-affiliated Students;
- consent for any images, stories, or information about the Student included in the Campaign.
1.3. Will maintain documentation of all consents and authorizations and provide them to KidStarter upon request.
1.4. Will promptly revoke or update a Campaign if consent is withdrawn or authorization is rescinded.
2. Accuracy and Honesty
2.1. You agree that all Campaign information — including the Student's need, the stated purpose of funds, supporting documentation, and narrative content — is truthful, accurate, not misleading, and supported by documentation when requested.
2.2. You will promptly update Campaign information if circumstances change (e.g., the need has been met, the Student has changed schools, or the cost has changed).
2.3. You will not create Campaigns for fictional students, fabricated needs, or for the purpose of personal enrichment.
3. Child Safety and PII
3.1. You must comply with the Safety & Child Protection Policy and the Children's Privacy Notice at all times.
3.2. You must not publicly disclose identifying information about any minor, including but not limited to full last names, addresses, phone numbers, school names (unless approved), or any information that could be used to locate, contact, or identify the Student.
3.3. You are responsible for ensuring that any images you upload do not contain visible identifying information (see the Safety & Child Protection Policy Section 1.3).
3.4. Mandatory Reporting Awareness: You acknowledge that in many jurisdictions, educators and persons working with children are mandated reporters of suspected child abuse, neglect, or exploitation. Your obligations under applicable mandatory reporting laws are separate from and unaffected by these Terms. If you become aware of abuse, neglect, or exploitation in connection with a Campaign, you must follow your jurisdiction's mandatory reporting requirements.
4. Data Protection Obligations
4.1. To the extent you handle Student Personal Data in connection with the Service (e.g., collecting guardian consent, providing enrollment information), you agree to:
- process Student data only for the purposes of the Campaign;
- keep Student data secure and confidential;
- not share Student data with unauthorized third parties;
- comply with all applicable data protection laws, including GDPR, UK GDPR, COPPA, and PIPEDA as applicable;
- promptly notify KidStarter if you become aware of any unauthorized access to or disclosure of Student data.
4.2. You are a data controller (or equivalent under applicable law) with respect to Student data you collect independently. KidStarter is a separate data controller with respect to data processed through the Service.
5. Verification and Review
5.1. Campaigns may require verification evidence before publication, including:
- school email/domain verification;
- school authorization letter;
- guardian authorization form;
- invoice, quote, or proof of need;
- proof of enrollment or eligibility.
5.2. Campaigns may be reviewed before publication and may be subject to ongoing review at any time.
5.3. KidStarter may request additional documentation at any time, including prior to or after disbursement. Failure to provide requested documentation may result in Campaign pause or removal.
6. Use of Funds
6.1. You agree to ensure that Campaign funds are used only for the stated educational purpose described in the Campaign.
6.2. You acknowledge that disbursements are made directly to verified schools or approved vendors under the Disbursement Policy — not to you personally, the Student, or the Student's family.
6.3. If the educational need changes or has been met, you agree to promptly update the Campaign and cooperate with KidStarter on reallocation or refund processes.
7. Content License and IP Warranties
7.1. You grant KidStarter the license described in the Terms of Service Section 10, including the right to create social-share assets derived from Campaign content.
7.2. You represent and warrant that:
- you own or have all necessary rights, licenses, and permissions for all User Content you submit;
- your User Content does not infringe any third party's intellectual property, privacy, publicity, or other rights;
- you have obtained all legally required consents for any images, stories, or information about the Student or other individuals included in your Campaign;
- your User Content does not contain unlawful, defamatory, or harmful material.
8. Indemnification
8.1. You agree to defend, indemnify, and hold harmless KidStarter and its affiliates, officers, directors, employees, and agents from and against all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from or in connection with:
- your breach of these Creator Terms or any part of the Agreement;
- your Campaign, including any misrepresentation of authority, need, or Student information;
- your User Content, including any infringement of third-party rights;
- your failure to obtain required consents or authorizations;
- your violation of any applicable law, including data protection, child safety, and mandatory reporting laws;
- any claim by a guardian, Student, school, or third party related to your Campaign.
8.2. EU/UK Consumer Note: This indemnification provision applies only to the extent permitted by applicable consumer protection law.
9. Enforcement
9.1. Violations of these Creator Terms may result in:
- Campaign editing, pause, or removal;
- Account restriction or suspension;
- Forfeiture of undisbursed funds;
- Reporting to payment processors;
- Reporting to law enforcement or child protection authorities;
- Legal action.
9.2. KidStarter reserves the right to take any enforcement action it deems necessary to protect Students, Donors, and the integrity of the Service, including immediate action without prior notice in cases involving child safety.
